Flexible labour

The use of flexible labour makes organisations agile. Whether it involves borrowing or supplying personnel, the flexible deployment of own staff or the deployment of self-employed persons, we are familiar with the complex and ever-changing regulations.

De ins- en outs van flexible labour

Ever-changing laws and regulations place limits on the use of flexible labour. This has an impact on companies using flexible labour and, of course, on the temporary employment sector and payroll companies. We know both sides and advise on borrowing and supplying flexible workers. Whether it concerns employees or self-employed persons. Or temporary employment, payrolling, secondment or platform work. National or cross-border. We know the ins-and-outs.

Paying attention to various interests

We search within the boundaries of the law for opportunities to make organisations agile. We pay particular attention to the division of responsibilities between the various parties involved. With an eye for different interests, we record the agreements clearly and unambiguously and inform you of the consequences of the chosen construction. Sometimes that is not enough and discussions arise about the nature of the employment relationship. A self-employed person could possibly still be an employee or a temporary worker a payroll employee. The qualification of the employment relationship determines the obligations that apply.

Naturally, we advise you in advance on choices and risks, but you can also count on us in case of legal disputes.

What we do

  • We think with you about how to make your organisation agile.

  • We advise on various forms of flexible labour and the rights and obligations involved. And of course we know the ins and outs of the Placement of Personnel by Intermediaries Act (WAADI, Wet allocatie arbeidskrachten door intermediairs), the applicable collective labour agreements (ABU/NBBU) and the industry-wide pension fund STIPP.

  • We draw up employment contracts and terms of employment regulations. We do this in 'classic' and 'popular' style. Of course, always in clear language and tailored to your flexible workers.

  • We clearly record agreements made between borrowers and suppliers and, for example, draw up general terms and conditions for the temporary employment sector and payroll companies.

  • We advise and litigate on contracts for services with self-employed persons without employees (self-employed persons). Of course we also draw up those agreements.

  • We advise on terms of employment of the flexible staff, such as the applicable collective labour agreement, pension and application of regulations within the organisation.

  • We help you draw up regulations to organise internal flexibility, such as a homeworking policy.

  • We advise on 'work-life balance' rights and obligations, such as special leave requests, requests for adjustment of working hours and requests for changes in work location and working hours.
