The above-mentioned regulation makes a distinction between different risk profiles. As AI poses higher risks to citizens, the obligations for AI innovators increase. These innovators, such as those who develop or want to apply AI, must comply with the standards set out in the regulation. In addition, the Product Liability Directive has been revised and updated. The European Commission and the European AI Office will also publish guidelines on the AI Act in the near future.

The Product Liability Directive has been revised in light of the emergence of AI technologies and entered into force in December 2024. Software and AI are now covered by this regulation. Developers are required to continue to provide AI systems with security updates. Here too, evidence requirements for AI manufacturers have been included and the burden of proof for victims of defective AI systems has been lowered. In addition, the system of liability exclusions has been revised.

Of course, there is also the General Data Protection Regulation (GDPR), which already applies to most AI applications. In addition to the general obligations, there are more specific rules concerning automated decision-making and profiling.
